Speaking Through My World with Rosie Motene
The Law vs GBV/IPV
The Law vs GBV/IPV
Society and communities are quick to say that victims/survivors of GBV/IPV should open cases and let the law take its course. The reality is that the course has many loopholes and challenges which can be exacerbated by those in power or who have certain privileges.
In this podcast, I speak on two specific cases.
* Monique Muller received a positive outcome from The Legal Practice Council. Monique made a formal complaint against Mrs E J Louis (Thomson Wilks Inc.) .
The Disciplinary Committee considered the matter on 19 September 2023 and found that Mrs Louis contravened two charges and was found guilty. For both charges, the Committee IMPOSED a FINE of R20 000 half of which is suspended for 5 years on condition that Ms Louis is not found guilty of the same or similar offence within the said period.
* The other case I refer to is a positive judgement passed down by the Johannesburg High Court, that overturned a protection order against an alleged perpetrator. The legal team that took on the case pro bono for the victim/survivor is Melvin Neale Inc.
